Files found with Special:Search/insource:"historiatc.com.ar"[edit]

The source of this image is the Internet forum https://historiatc.com.ar and their real source are Argentine sport magazines like "El Gráfico", "Corsa", etc. The images are from the 1990s and in the Argentine public domain. However, they are still protected by copyright in the US as they were published after 1 March 1989, when the US entered the Berne Convention.

Günther Frager (talk) 13:21, 6 November 2023 (UTC)Reply[reply]

Hello. I understand that the photos are still protected by copyright in the US but why is the PD-AR-Photo tag allowed to use here? And what license tag can we use for the photos if there is any available? I would appreciate it if you could help me with that. Regards. Maxi-Napo-99 (talk) 21:20, 8 November 2023 (UTC)Reply[reply]
@Maxi-Napo-99 The issue is that our policy requires images to have a free license (like CC-BY), or to be in the public domain in both its country of origin and the United States. This usually requires having two tags, one for Argentina and another for the US. An example is this image that uses {{PD-AR-Photo}} and {{PD-US-1996}}. As a rule of thumb, photos from Argentina after 1 March 1989 need a Creative Commons license, photos published between 1971 and 1989 require a lot of care as the majority are copyrighted in the US (you need to read about COM:URAA), photos published in Argentina before 1971 are mostly fine (tags should be like I showed before), and photos published in Argentina more than 95 years ago are completely fine. I will try to update the tag for Argentina to make uploaders aware of it as it is not fun to get photos deleted when there was good faith. Günther Frager (talk) 22:12, 8 November 2023 (UTC)Reply[reply]
Thank you for responding. I understand. Should I update the photos with the PD-AR-Photo and PD-US-1996 tags then? Or I wait until the PD updated tag is available? Maxi-Napo-99 (talk) 06:35, 10 November 2023 (UTC)Reply[reply]
In order to apply {{PD-US-1996}} the photos must be published before 1 January 1971, these images are from the 1990s. If the solution was to apply a missing tag I wouldn't have nominated them for deletion. Günther Frager (talk) 10:09, 10 November 2023 (UTC)Reply[reply]

Copyright status of the statue is not clear, see the discussion at Commons:Village_pump/Copyright#License_tags_for_photographs_of_original_works Phlsph7 (talk) 13:38, 6 November 2023 (UTC)Reply[reply]

If the author is Νικόλαος Παυλόπουλος (1909–1990), as seems probable, I don't see how the photo could be kept. Copyright in Greece lasts 70 years pma and they have no relevant FoP (according to COM:Greece). Additionally, US copyright applies: it is unlikely that the statue was erected before 1928.
However, before deletion, projects that allow fair use should be allowed time to upload the file locally, and this discussion should be put in an undelete-in-X category.
Probably the file has to remain deleted until the later of 2061 and 95 years after the "publication" of the statue. Does somebody know the latter year?
LPfi (talk) 10:21, 8 November 2023 (UTC)Reply[reply]
Apparently it was erected in 1956, which would make it free in the US before it will be free in Greece. So undelete in 2061, from my perspective Felix QW (talk) 13:37, 8 November 2023 (UTC)Reply[reply]

Copyright status unclear. Uploaded states at my Wikipedia talk page that We're a scholarly non-commercial photo group with the purpose of putting useful images on Wikipedia. All member-photogs understand that and all give copyright to NelsonExpression and then give it up to PD from there. No evidence of any donation of copyright. Velella (talk) 14:55, 6 November 2023 (UTC)Reply[reply]

keep (OP) More of that quote: "All member-photogs understand that and all give copyright to NelsonExpression and then give it up to PD from there. We use the one account for uploading since there's only one experienced Wikipedian in the group. Just as if Magnum Photo or Time Magazine or UPI were the account, they'd still identify their original photographers while controlling the member images." If one wants to hyper-parse words on image descriptions so much, then what evidence is there of any WP image's donation of copyright? Each image uploaded says specifically in its description that the photog donated copyright and it's PD for Wikipedia to use. Thought that was clear enough. Would you suggest different wprding? The account is doing a name change per an admin's advice to reflect uploading by the individual editor of the photos donated by the photogs. It's okay! The group formed in order to put photos on WP and everyone knows they donate the copyright so WP may use them.
NelsonExpression (talk) 16:57, 6 November 2023 (UTC)Reply[reply]

For each image, the copyright holder needs to provide evidence of permission by either providing a link to a site with an explicit release under a free license or by sending a declaration of consent to permissions-commons@wikimedia.org. There's full instructions at Commons:Volunteer Response Team. This applies to the following uploads:

Clearly not own works. According to the information put here by the uploader, these maps are created by the Institute of Geography and published in an unknown date. These would fall in the public domain per Iranian law if there is a proof they were published before 1993 and the institute was the copyright holder, but we cannot confirm that for now.

There is no commercial freedom of panorama in Korea. Gamgol Citizen's Hall was built in 2001, and so still under architect's copyright and is unfree. As no architect or designer is named, copyright remains for 70 years from the year of completion. Do not restore this image until 2072 (assuming the architect remains unknown to Commons admins and license reviewers). JWilz12345 (Talk|Contrib's.) 18:05, 6 November 2023 (UTC)Reply[reply]

  • Keep. Realistically, this is just a classic case of meta:Copyright paranoia. Sure, I know, Commons:PP says otherwise, but common sense would be nice to have around here. Shrug. At least make sure to tag it for undeletion in 72. --Piotr Konieczny aka Prokonsul Piotrus Talk 08:44, 7 November 2023 (UTC)Reply[reply]
@Piotrus we don't keep unfree content here. Commons strictly adheres to the Definition of Free Cultural Works, which is a basis of COM:Licensing policy and the media archive site's disallowance of copyrighted public structures from countries that do not allow commercial exploitations of those works without permissions from artists and/or architects, like the supposedly-free Korea (North Korea is better here as their law allows free reproduction of public landmarks, something South Korean law restricts). JWilz12345 (Talk|Contrib's.) 09:12, 7 November 2023 (UTC)Reply[reply]
Freedom of panorama is an interesting concept. I fully support reforming various laws to make it a global concept. However, the fact that it is not happening is related to the simple truth that nobody cares about it because outside Wikipedia nobody enforces it or knows about it... Piotr Konieczny aka Prokonsul Piotrus Talk 10:58, 7 November 2023 (UTC)Reply[reply]
@Piotrus real-life FOP-related cases have been heard in the United States (like the Gaylord v. United States over the Korean War Veterans Memorial, as well as cases of commercial uses of murals and graffiti by fashion, retail, and automobile companies there), in France (especially two 1990 cases involving Grande Arche and La Geóde, and the case of Place de Terreux of Lyon that established French incidental defense for commercial users), and in India (over a wall painting, in the 50s/60s). There has been a case in South Korea though, concerning a building (see w:en:Freedom of panorama#South Korea), but the court ruled in favor of the user in the first trial because the building just happened to be a small part of the advertisement, though before another trial was to be conducted, the architect decided to make a settlement outside the court, so no conclusive decision has been reached. Image taken from Facebook and clearly published early in a magazine, but no real source is given. Finding it on Facebook is not enough to claim it is an anonymous work (the excuse to argue it is in the PD). Also {{Not-PD-US-URAA}} can only be used for images published before URAA date (1996), and for uploads prior to 1 March 2012. This image doesn't satisfy neither. This file was initially tagged by IagoQnsi as no permission (No permission since). It sounds like IagoQnsi hasn't seen an original. Stolen images tend to be in a smaller size than this (1,732 × 2,309 pixels), actresses may pose for amateur photographers for a fee. I would say there is a too weak basis for speedy deletion ("Unless this issue is resolved, the file will be deleted seven days after this tag was added "), so I'm converting this to a regular deletion request. whym (talk) 12:45, 29 March 2023 (UTC)Reply[reply]

I understand that the file I uploaded has been nominated for deletion.
I followed the guide and sent a license approval email to VRT (March 25th).
What else can I do?
I trimmed it when I uploaded it, but I also have the original image (with Exif information created by my digital camera) before trimming.
If you would like to send it for proof, please indicate where to send it.
Thank you.

  •  Keep No reason to assume the uploader stole it from an unidentified source. The original deletion rationale is refuted, from my perspective. A non-trimmed version would be nice but not strictly necessary, given the lack of argument for deletion. whym (talk) 12:50, 2 April 2023 (UTC)Reply[reply]
    thank you.
I am ready to upload the original photo, so if there is an opinion that it should be deleted, I will upload the original file.
However, since it is a landscape and has an unnecessary background, I would like to avoid re-uploading if possible.

I thought it was concluded that the file subject to the deletion discussion would survive, but it seems that it was deleted today.
I don't understand the reason or the basis.
I also sent the permission to VRT as instructed, but was there any reason why it didn't work?
You asked me to request the cancellation of the deletion after 14 days, but do I have to wait until then?
I would appreciate it if you could let me know.

Comment A ticket is mentioned in the file: ticket:2023032510003115. Yann (talk) 14:24, 25 April 2023 (UTC)Reply[reply]
ticket:2023032510003115 was closed 2 weeks ago, which does not mean a rejection. In this case, the ticket is deemed unnecessary. [2][3] If we have reasons to be extra careful, we could do more (like requesting and verifying other versions of the picture as suggested above), but that costs extra time and effort and I would rather do that only when necessary. whym (talk) 03:19, 27 April 2023 (UTC)Reply[reply]
ticket:2023032510003115 is accepted now. A new email arrived. Although I personally didn't demand it, I have no problem with accepting voluntarily sent evidence. whym (talk) 12:39, 30 April 2023 (UTC)Reply[reply]

  • You probably removed it from the article where it was being used. But what is your issue? You jumped through hoops this April to make sure it could be used, and now you want it deleted in November? How is that logical? -- Ikan Kekek (talk) 16:07, 11 November 2023 (UTC)Reply[reply]
thank you for your reply. I apologize for making a request that is difficult to understand.
For a long time, there was no photo of "Tsubaki Sannomiya" on the Japanese version of Wikipedia, so I thought some kind of photo was needed, so I added the one I took to Commons, and then added it to the Japanese version of Wikipedia.
However, the photo was extremely unpopular, with many saying it was drastically different from the person's appearance, and multiple channels advised me to take it down.
For this reason, I immediately removed the photo from the Japanese Wikipedia that I had added.
However, during that period, it was discovered that another user added the photo to the Chinese version of Wikipedia, causing the inappropriate photo to be displayed in searches.
For this reason, I decided that I wanted to delete the original Commons file.
I don't know the details, but even if I created a photo, can I delete it if I think it's inappropriate?
Thank you for your judgment.-- Kuro itengineer (talk) 21:31, 11 November 2023 (UTC)Reply[reply]
  • What did people consider inappropriate about the photo? -- Ikan Kekek (talk) 02:21, 12 November 2023 (UTC)Reply[reply]
The photo was taken by me, but it was pointed out that it was far from the actual appearance of the person, perhaps because my skills were inexperienced, the timing of the photo was bad, or there was a lighting issue. If you were an ordinary person, you might not have made such a point, but since he is a person with many fans, I think they are particularly concerned about his appearance. I myself am confused and exhausted and would like to escape from such problems.-- Kuro itengineer (talk) 21:00, 12 November 2023 (UTC)Reply[reply]
  • I'm sympathetic to you, but I just looked at the category, and this is the only photo of her on Commons, so I have to oppose deletion on that basis. However, if you are able to take a better photo and upload it, you'd have a much stronger argument for a courtesy deletion of this one. -- Ikan Kekek (talk) 01:19, 13 November 2023 (UTC)Reply[reply]
Thank you for your kind reply. In fact, I have already uploaded and published new another photos that I took in the Japanese Wikipedia article. However, in consideration of unintended disclosure like this, I chose to upload the Japanese version locally. There is a way to upload this file to Wikimedia Commons instead of requesting its deletion, but I cannot decide on this right away at this time. Kuro itengineer (talk) 06:06, 13 November 2023 (UTC)Reply[reply]
  • Unless there's a copyright issue, photos should be uploaded to Commons, not locally to Wikipedias. -- Ikan Kekek (talk) 07:07, 13 November 2023 (UTC)Reply[reply]
Thank you for your advice! Although I'm a little nervous, I decide to upload the new photo to Commons. Once that's done, the best option seems to be to delete your old photos. Kuro itengineer (talk) 20:23, 13 November 2023 (UTC)Reply[reply]
I just imported a new photo from the Japanese version of Wikipedia. I would be happy if you could delete this if there is no problem. Kuro itengineer (talk) 21:04, 13 November 2023 (UTC)Reply[reply]
  • I can't delete anything, but could you link the photo? -- Ikan Kekek (talk) 23:54, 13 November 2023 (UTC)Reply[reply]
I don't really understand the detailed mechanism or procedure, but if you can't delete it, you can leave it as is. I apologize for the inconvenience. The new photos that were in the Japanese version locally were imported to Wikimedia Commons, and the original local files were also deleted. I would like to add this Commons image to the Chinese version as well. Old photos will remain, but there will be no objections as long as they are actually used. thank you very much. Kuro itengineer (talk) 05:35, 14 November 2023 (UTC)Reply[reply]
  •  Delete Thanks. The new photo is better than the old one. I think a courtesy deletion is OK. You said you had more pictures? I encourage you to upload what you have. -- Ikan Kekek (talk) 14:50, 14 November 2023 (UTC)Reply[reply]
Thank you very much. I have several photos, but they are from similar angles, so I will think carefully about whether to upload them.-- Kuro itengineer (talk) 15:21, 14 November 2023 (UTC)Reply[reply]

Bonjour !
-- Asclepias (talk) 21:22, 17 November 2023 (UTC)Reply[reply]
  • Delete. Requires VRT confirmation if the uploader was the owner of the copyright as claimed. -- Asclepias (talk) 21:22, 17 November 2023 (UTC)Reply[reply]
