As the creator of this photograph, I have been contacted by the University of Central Florida's Office of the General Counsel. I was asked to delete the file on the grounds that it allegedly constitutes trademark infringement.   •  Question What is the rule in the U.S.? Is this considered a sculpture and therefore not OK under COM:FOP US, or is it considered part of a building, and therefore OK? If it's OK in terms of copyright, we should keep it because it's COM:INUSE, and Commons does not enforce trademarks, nor could a university demonstrate that you injured their trademark just by posting for free a photo of their logo on a building. The source image (File:Brasão Algueiro.jpg) was previously tagged by his uploader with a Commons-compatible license, but then tagged with Copyvio and deleted as is source was araldicavica.it, that publishes under CC-BY-NC-ND. I'm sure that the creator of the flag was in good faith, but now that the source image has been deleted, I think the flag should be deleted too as DW of a non-free image.
Also, the intense use of this flag should not be a problem, as the image can be easy recreated using this CC-BY-SA-4.0 CoA. Anyway, this flag design does not seem to have an official recnognition by the municipality, as it's not mentioned in the Statuto comunale and the municipality itself uses the version without CoA. --Arrow303 (talk) 13:59, 9 November 2023 (UTC)Reply[reply]

It can always be the same design with a different file name. There are many similar cases in Commons. Since I'm the original uploader of this file and indeed I had no idea that the CoA was copyrighted when I created and uploaded the file, I agree that editing sounds reasonable. Any idea btw why this following file with the CoA hasn't been deleted too?

@Argean @King of Hearts, That CoA has been redesigned by the uploader, that published it under CC0. The copyright, in the context of coats of arms, it's measured by looking at the single representation that any artist can make starting from the same blazon (which, being a written description, is free from copyright). The CoA included in this image was mistakenly tagged by its uploader with CC-BY-SA, when it was not. I agree with changing the central coat of arms (we also have this version, that may be better), but shouldn't we upload this new version as a separate file as per COM:OW?
I suggest to make this image a redirect to File:Flag of Catalonia.svg (also because the official flag seems to be without CoA), then create and upload the flag with the CoA, that can be named File:Flag of Alghero (de facto).svg, or something similar. https://catalog.archives.gov/id/7665726 is clearly the original image, and was taken in California, not Sweden. The Nobel Prize Committee photographs are not necessarily by the Nobel Prize organization, which seems to be the fundamental mistake made here, by presuming that, since this was published alongside the Nobel Prize announcement, that it was taken in Sweden. We know the photographer per that link: It's Donald Cooksey, who is not Swedish. Clearly, given the National Archives has a less-cropped version of the photo which copyright is claimed on, this was not taken in Sweden, is not an "Official Nobel Prize photo" in any sense that would move the copyright to Sweden, and the argument based on it being a Swedish photo is not accurate. Now, it sucks to have to delete it, I fully agree, but, we do have a good photo of him, File:Luis Alvarez with a magnetic monopole detector.jpg, which I would argue is in some ways better.

It's possible that the University of California copyright claim is one that we at Wikipedia shouldn't accept per {{PD-Art}}. That's a fair arguement if we can show that Donald Cooksey was working for the federal government - He's Donald Cooksey, so this shouldn't be hard - or we could argue a PD-US-no-notice if it was published without a copyright claim. However, that's not at all what's being argued for the reason the photo is out of copyright, and we'd need to update the file pages to a valid copyright claim at a minimum.

So, to bulletpoint the problems:

  • The author is not the Nobel Foundation, it's Donald Cooksey
  • It was not taken in Sweden, it was taken in California, at the Lawrence Berkeley National Laboratory
  • It was not taken in 1961; it was taken on January 2, 1962.
  • He got his Nobel Prize in 1968, so the dates don't even add up for this being anything to do with the Nobel Prize Foundation.
  • {{PD-Sweden-photo}} does not apply to photos taken in California by Americans. Forgive me if that comes off as really sarcastic, but the point is that, if it's kept due to other arguments than the ones currently made for it being out of copyright, we really need to fix the bullshit documentation. We can't keep using an obviously incorrect license for it.
  • For {{PD-US-no-notice}} to apply, we'd need evidence of it being published in the United States without a notice during the period where that caused it to lose copyright. A modern Dutch archive or a modern Swedish webpage won't do that.
  • For {{PD-USGov-DOE}} to apply, we'd need to get around the Federal Government asserting a copyright for the University of California. Now, bullshit arguments for copyright exist all over the place, and Cooksey was Associate director of the Lawrence Berkeley National Laboratory, so there's probably good reason to think this is bullshit, especially as the phrasing might indicate that the University of California are claiming copyright for scanning it ("has asserted a continuing legal interest in the digital versions of the images included in the NARA accession"). But it's not completely clear whether that's the exact claim made.

However, the en.wikipedia article states that it was founded "10 July 1992 (as Workers' Party); 15 February 2015 (rebranding)," so it's way too new for their logo to be in the public domain, and I'd have to think it's above COM:TOO Turkey. So a representative of the party would have to give permission for it to be licensed here.   •  Keep Per this aeticle about the history of the logo it orginates from a shield that the company created the design for in the earlier 1900s. Although this verison is admittedly a few iterations from that, but its essentially the version from the 1960s which probably wasn't copyrighted due to a lack of a copyright symbol on it at the time. But a shield is a shield regardless. So you could argue its either to close to the 1960s version to be copyrighted since that kne probably wasn't or the one from the early 1900s hundreds if you want to go that far back.  Keep The logo was published without a copyright notice from at least the 1920s to the 1970s, which is a time period when a copyright symbol and other formalities must have been attached to "every published copy" for copyright to vest. The Copyright Office was occasionally willing to overlook occasional technical noncompliance with the copyright laws and register a copyright in the 1970s, but millions of copies of the logo without a notice over decades certainly injected the historical logo into the public domain.
Whether the drop shadow, changes to the stem of the logo, and outlining could perhaps be sufficient to create a new copyright for current version is more difficult. IMO the changes fall below the TOO for the US. Streamline8988 (talk) 00:39, 12 November 2023 (UTC)Reply[reply]
