Files in Category:Stained glass windows in Altenahr[edit]
Unfortunately FOP in Germany doesn't cover churches or building interiors and the artist of these windows, Rudolf Schillings, died in 2003. So these images should be deleted as COPYVIO until at least 2074.

- Delete. @Adamant1: what was created in 2951? Do you mean 1951? These windows are in w:de:Maria Verkündigung (Altenahr) church, which is medieval. However, these have the appearance of designs from the 1950s and 1960s. Spurzem has attributed File:Altenahr MariäVerkündigung Glasfenster391.JPG to Rudolf Schillings (1925-2003),[1]. The following files include the same RS monogram, so are probably also his work.

We don't have the name of the artist for several of the windows, only for the eight with the RS monogram. The other files should also be deleted, but not tagged with 'Undelete in 2074'.Verbcatcher (talk) 07:40, 12 October 2023 (UTC)- The Forschungsstelle Glasmalerei des 20. Jahrhunderts (20th Century Stained Glass Research Centre) attributes all these windows to Rudolf Schillings.[2] This appears to reliable, so all the files should be deleted until 2074. Verbcatcher (talk) 07:59, 12 October 2023 (UTC)
- The ones that don't have his initials on them are made by the same company he worked for and are in the exact same style as the other windows that were created by him. Plus their also from the same time period. So I doubt they were created by anyone else. --Adamant1 (talk) 09:02, 12 October 2023 (UTC)

- @Apetrov09703: See Commons:When to use the PD-Art tag#This does not apply to photographs of 3D works of art and more: A photograph of a 3D-object creates in most jurisdictions a new copyright on the picture, something that is not the case when photographing pure 2D-objects. - Answer is No, thanks for clarification 18:02, 11 October 2023 (UTC) Apetrov09703 (talk) 18:02, 11 October 2023 (UTC)

File:Guerre 30 ans 1.jpg[edit]
The quality of this file is atrocious. It has been tagged for needing improvement for nearly 20 years and this has not happened. It's not only the bad quality of the image; it also depicts a 17th century war using 21st century borders, which is very confusing. Such poor quality content has no place in an encyclopædia and makes Wikipedia look bad. Gerrit (talk) 12:16, 11 October 2023 (UTC)

No commercial freedom of panorama in Ukraine so this is a derivative work and NC. KazyKazyKazakhstan (talk) 13:38, 11 October 2023 (UTC)
- Keep because of the 'independent economic significance' clause in Ukrainian FOP. This image depicts more than a dozen different graves by different authors, none of which is prominent nor of high enough quality/detail to be independently economically significant. In addition, the graves in foreground are the oldest (of people died ~100 years old) — NickK (talk) 21:38, 14 October 2023 (UTC)
- Commons works have to be allowed for commercial reuse when modified. It would be easy to crop to focus on a single copyrighted 3D element.--KazyKazyKazakhstan (talk) 00:55, 15 October 2023 (UTC)

- But Commons has stricter rules about work being modifiable and redistributable commercially. The image can be cropped to show a single copyrighted grave.--KazyKazyKazakhstan (talk) 01:46, 15 October 2023 (UTC)
- Unfortunately we don't have any court practice on the 'independent economic significance' in Ukraine because it was only introduced this year and it is a completely new norm in Ukrainian copyright. The only thing we know about it is that it was inspired by something EU. The only EU countries without FoP but with similar norms are France and Italy, and in both landscapes involving copyrighted works are considered acceptable on Commons, e.g. Commons:Deletion requests/File:Ladefense100 4008.JPG for France or Commons:Deletion requests/File:Genova-panorama dal santuario di ns incoronata3.jpg for Italy. I think we should follow a similar guideline until a clearer one is published — NickK (talk) 13:02, 15 October 2023 (UTC)
- I think we should err on the side of caution and delete because FoP violations can cost well-meaning people millions of dollars like the Vegas statue of liberty postage stamp incident.--KazyKazyKazakhstan (talk) 14:49, 15 October 2023 (UTC)
- We can't just say that there is a new norm but we decide to ignore it. How do you understand the 'independent economic significance' (самостійне економічне значення) norm then? Note that it is not the same norm as commercial use (комерційна мета) or indirect commercial benefit (опосередкована комерційна вигода), as these two terms are separately used in the Ukrainian copyright law — NickK (talk) 20:33, 15 October 2023 (UTC)
- What part of right to make derivative works ie crop something do you not understand? ND is not allowed on Commons.--KazyKazyKazakhstan (talk) 20:53, 15 October 2023 (UTC)
- @NickK I don't think File:Genova-panorama dal santuario di ns incoronata3.jpg is de minimis. The Italian bridge is the central theme of the photo. But bridges in most countries (U.S., Italy, South Korea, the Philippines etc.) are generally not copyrightable works. Exceptions are brdiges in France, Thailand, and Singapore where bridges are copyrighted as architectural works even if the designers were engineers. (Again this is off-topic) JWilz12345 (Talk|Contrib's.) 00:02, 16 October 2023 (UTC)
- @JWilz12345: Maybe I picked the wrong example for Italy. Still the fact is that Ukrainian lawmakers are known to be inspired by a 'European Union' norm. I don't know any other EU country with such a norm except France (Italian norm seems to be a bit different as you say), and in France similar photos are accepted on Commons. I don't think it's really off-topic because there is a new norm without any court practice yet, so we do need to find a way how it should apply — NickK (talk) 11:06, 21 October 2023 (UTC)
- See also Category:PD structure (Italy) for more images of the Italian bridge. JWilz12345 (Talk|Contrib's.) 00:03, 16 October 2023 (UTC)

- Keep. Intact Exif data is consistent with several of Cancanisstory's other uploads. Photo taken one day before upload here. It's unlikely that the claim of it appearing elsewhere before that is accurate.
