Unfortunately there's no FOP in Ukraine and at least one of the sculptors of this statue, Pavlo Chechelnytskyi, seems to still be alive. So these images should be deleted until an undetermined date.

I have cropped File:Senadora María Fernanda Cabal (Colombia).jpg which shows just the Senator. As María Fernanda Cabal is a Colombian politician, I understand that her privacy is not invaded. All other people have been removed from the picture. So I propose that the cropped file should be kept, even if the source file is deleted on privacy or promotional grounds. Unfortunately there's no FOP in Ukraine. Nor is there any evidence that the sculptor of this statue has been dead for more then 70 years since it was created after World War 2. So these images should be deleted as COPYVIO until an undetermined date unless someone can provide evidence to the contrary.

The earliest documented installation of this monument was in Vvedenka in Kharkiv Oblast in 1946, and the monument used there is the completely identical Воїн з вінком to the one used in Kremenchuk. It's not like people don't retain the copyright to something just because it was mass-produced or there's multiple copies of it out there. @Adamant1: Well, this was USSR. The name of the original sculptor was never made public, all of these works are attributed just to Харківська скульптурна фабрика. It was legal in then USSR: the 1961 amendments to the copyright law retroactively transferred copyright to corporations (see en:Copyright law of the Soviet Union). As a result, even if an unidentified employee of the Харківська скульптурна фабрика used to own copyright on this sculpture, in 1961 the copyright was transferred to the corporation. It was then presumed to be perpetual, but 1993 amendments brought it back to 50 (and later 70) years since first publication. 70 years have passed since 1946, thus it is now in public domain — NickK (talk) 00:21, 21 November 2023 (UTC)Reply[reply]

In all monument registers (provided by Poltava Oblast State Administration and Kharkiv Oblast State Administration respectively) these monuments are attributed to Харківська скульптурна фабрика. The name of the sculptor does not appear anywhere, while for other monuments they do write the name of the specific author. It is pretty clear from these sources that Харківська скульптурна фабрика was officially the copyright holder of this monument (it was during Stalin times and to honour the Soviet Army, could an employee working on this project really refuse to transfer their copyright to a government institution?) — NickK (talk) 23:55, 21 November 2023 (UTC)Reply[reply]

The nominator doesn't even bother to read the description pages. Read the description: design used in 1937. Count: 1937+50=1987. 1987<2021. This DR is sloppy, like other recent DRs. Other users put effort, time and care into uploading files, researching the information and describing the files. The least the nominator could do is read the descriptions. The indiscriminate nomination of everything without research is harmful.

Additionally, the uploader is not the photographer of several of these files, and there is no evidence of permission. Some are own photos but not covered by FoP because they're paintings or in private collections and thus not permanently exhibited in a public place. Works from 1962 or before would be PD in the US when the Canadian copyright expires, but the artists works from 1963 to 1987 would have to be undeleted later than 2058.

@Abzeronow The municipal flags are created by municipal decree by the municipal gazette, which according to article 54 of the Copyright Law, these may be freely displayed where any individual desires, the same provision that Korea has, as happens in here.
The emblems, flags, etc. are the product of a decree therefore they are free of copyright as stated by law. Just as the coat of arms of Honduras would be in public domain, even if it were not more than 75 years old (after the death of the author).   • Why do you think I have the authority to decide whether this photo should be deleted or not, let alone to remove the deletion template before a decision has been made? I don't. I seem to remember photos of telecommunications towers in Russia, Ukraine, Kazakhstan and other ex-Soviet countries being deleted for lack of commercial freedom of panorama. If Uzbekistan is somehow an exception, and this photo can be legally licensed for commercial use, I hope the closing admin rules that way.     The structure in the photo is not covered by FoP because it is simple and does not meet originality. My country doesn't have FoP for architecture which means that photos of things considered architecture can't be commercialized unless the work of architecture is old enough.

AVSOPS is the abbreviation for the American Veterans Service Organizations & Patriotic Societies. It's certainly not a governmental organization and I don't think it existed until several decades after this photo was taken; it's very unlikely that the man who formed the company, Edwin L. As per Commons:Village pump/Copyright/Archive/2022/01#Reichstag Dome and German FOP. The rooftop area is not considered a place freely-accessible to the public as it can only be accessed through prior registration, not a free entrance without entry control. Thus these images of the dome from the rooftop or interiors cannot benefit from German freedom of panorama, which is strict on location of the photographer, not the physical location of the artwork. Thus these images need commercial license permission from the artwork author, Architect Lord Norman Foster.

Images taken from the ground outside the Reichstag or from the air are fine.

Also, it is useless to use it in another Wikimedia-wide campaign, if the dome in relation to the photographer themself did not pass German FOP standards (unless someone from Germany will use this in their lobby to widen German FOP scope to include public indoors regardless of entry requirements). But I doubt that: German legislature, courts, and academia won't expand German FOP anymore since it will be an abuse to artists' rights to earn extra for their living. Es gibt freien Zugang, nur eben mit den für solch gefährdeten Bereich notwendigen Sicherheitsmaßnahmen. Ich kann nicht erkennen, warum gewöhnliche Sicherheitsregeln einen öffentlichen Raum plötzlich nicht mehr öffentlich machen sollten. Außerdem sollte eine Genehmigung des Hausherren, sprich der Bundestagsverwaltung, vollkommen hin reichend sein.
BTW: In diesem DR sollte ausschließlich Deutsch gesprochen werden, es geht schließlich ausschließlich um den deutschen Rechtsraum und die hier geltenden FoP-Regeln, wer nur Englisch kann, hat sich hier rauszuhalten, das ist ein Zeichen von Unkenntnis. This is solely about some inner-German laws, written only in German, without profound knowledge of German language and laws nobody can say anything meaningful here. So very good knowledge of German is a conditio sine qua non for this discussion. At least one of the photographers here doesn't speak English, and his involvement is a must as well, so it must not be done in English, a language those who are concerned do not necessary speak.

English is the de facto lingua franca for Commons and allows most people to participate. If one doesn't understand English, Google Translate / Deepl are an option. No discussion on Commons is limited in scope to a single country or language area, because it's ultimately about whether we can host certain files for worldwide use, even though this might depend upon national law. Nicht von der Schrankenbestimmung erfasst sind nach einhelliger Auffassung des Schrifttums Aufnahmen und Darstellungen von Werken in Innenräumen auch von öffentlichen Gebäuden wie Museen, öffentlichen Sammlungen, Kirchen oder Behörden. Dies entspricht der ausdrücklichen Erwägung in der amtlichen Begründung, wonach die „in öffentlichen Museen dauernd ausgestellten Kunstwerke“ nicht privilegiert werden sollten, weil diese „nicht in dem gleichen Maße der Allgemeinheit gewidmet [werden] wie die Werke, die an öffentlichen Plätzen aufgestellt sind.“ Das Oberlandesgericht Köln verneinte vor diesem Hintergrund die Anwendbarkeit der Panoramafreiheit auf die Darstellung eines Kunstwerks im Plenarsaal des Deutschen Bundestags in Bonn.

This is in line with the express consideration in the official explanatory memorandum, according to which “works of art permanently exhibited in public museums” should not be privileged because they “are not dedicated to the general public to the same extent as works exhibited in public places are set up.” For this reason, the Cologne Regional High Court denied the applicability of the freedom of panorama to the presentation of a work of art in the plenary hall of the German Bundestag in Bonn.

Es stellte fest, dass es im Licht der europäischen Richtlinie 2001/29/EG (Urheberrechtsrichtlinie) und der weiten Verbreitung von Drohnen auf die Frage des Hilfsmittels und der Ansicht nicht mehr ankommen könne, und unterstellte jedes Bauwerk aus jeder Perspektive und mittels jedes Hilfsmittels der Panoramafreiheit.
Accordingly, the Federal Court of Justice denied the applicability of § 59 UrhG for the shot of a building protected by copyright from the balcony of a house opposite (to which everyone was given a key on request) simply because this “shows parts of the building that are different from the path, the street or cannot be seen from the square". Concerning this, whether a camera installation on the roof of a vehicle, which records the street scene from a height of 2.90 meters (Google Street View vehicles), still reproduces the view from the public street or public square and insofar as the privilege arises from § 59 UrhG, this is controversially discussed in the legal literature, but mostly rejected. The Frankfurt Regional Court no longer agreed with this view in 2020. It stated that in the light of the European Directive 2001/29/EC (Copyright Directive) and the widespread use of drones, the question of the tool and the view could no longer be relevant, and subordinated every building from every perspective and by means of every tool to the freedom of panorama.

With regards to this, it can be interpreted that only mid-air and aerial shots (like drone shots) were given consideration in recent German court rulings regarding panoramafreiheit, but views from certain parts of a building are still rejected by the courts. Views that would drastically change the normal appearance of a public artwork (like the Reichstag dome) as it is supposed to be seen from "public paths, streets, squares, high seas, coastal waters, sea waterways, and seaports" ("öffentlichen Wegen, Straßen, Plätzen, Hohe See, das Küstenmeer, Seewasserstraßen sowie Seehäfen"). And take note German FOP is too selective in the location of the photographer. In this case, the rooftop area is no longer a public space and the architect can claim damages to free uses of peoples' images of his work which is the dome. Mai 1995 wurde Fosters endgültiger Entwurf für eine gläserne, begehbare Kuppel vorgestellt, dem die Abgeordneten zustimmten. Der Architekt Calatrava erhob daraufhin den Vorwurf, dies sei ein Plagiat seines eigenen Wettbewerbsbeitrags, der eine transparente Kuppel ähnlicher Form vorsah. Nach Gutachten und Gegengutachten setzte sich die Ansicht der meisten Fachleute durch, wonach für ein traditionelles architektonisches Gestaltungselement wie eine Kuppel kein besonderer Rechtsschutz beansprucht werden könne. Außerdem hatte schon anlässlich der Ausrichtung des Wettbewerbs 1992 Gottfried Böhm seinen Entwurf für eine Kuppel veröffentlicht, die er 1988 im Auftrag von Bundeskanzler Helmut Kohl entworfen hatte.  Weak keep Though my native language is (Swiss) German, I prefer using English as our lingua franca here. If the Reichstag dome could be considered a work of architecture which is protected by copyright, then I would vote delete, as these photos aren't taken from public space in the sense of German FoP law, but from an access-restricted area where you can visit for free, but not freely. But per Stepro's argument, legal experts are of the opinion that this glass dome is a generic element of architecture that enjoys no copyright protection whatsoever to begin with. It would never have occurred to me that could be the case, as it's quite iconic IMHO, but if this is really the case, then we can keep the images.   1. The dome is a protected work of architecture. We apparently have sources claiming the opposite, but they probably only talk about whether or not the idea of a glass dome on top of the Reichstag building can be copyrighted, not about the specific design by Norman Foster.
  2. Freedom of panorama does not apply to the observation deck, as it is not a "public path, street, or square" in the sense of sec. 59 German Copyright Act.
  3. We do not have the permission from the rightsholder, as we have no evidence that Norman Foster transferred the entire usage rights of his design to the German government.
Therefore, sadly, we have to delete any and all photos depicting the dome taken from the observation platform.

Ich bin ja kein Jurist, aber nach meinem Verständnis gibt es auch so etwas wie die Intention von Gesetzen. Und hier sehe ich eine reine Überinterpretation pro vermeintlichem Urheberschutz gegen die Rechte der Allgemeinheit. Das dürfte so nie die Intention der Gesetzgeber gewesen sein. In English (via Google Trans): I'm not a lawyer, but according to my understanding there is also something like the intention of laws. And here I see a pure over-interpretation per supposed copyright protection against the rights of the general public. That should never have been the intention of the legislature. I also see Gnom's argumentation accordingly as not expedient. Keep in terms of my understanding of a deeper meaning behind pure legislation.
@Marcus Cyron: though the history of court rulings tend to be restrictive, only allowing commercial uses of German public artworks like architecture if the photos to be used are taken by photographers in public paths, roads, squares, waterways and open seas, port areas, and in the recent case from Frankfurt, from air/drone. None of the courts consider public premises (e.g. balconies) as allowed under German FOP. This may mean, the rooftop area, despite outdoors, is not covered by German FOP. Courts interpret the ambiguous laws and their rulings serve as models for future German FOP cases, whether real life or the likes of Commons deletion requests. I'm convinced by Gnom's statement. For transparency, I asked him in German Wikipedia whether he could contribute something to this discussion (as you can see if you have a look at his user page, it's not quite random that I ask him of all people ;-) ). So I'm striking my "weak keep" vote above and now vote  Delete as well. In my opinion, it seems to be clear enough that FoP doesn't apply in this case, and I would have voted for deletion from the start, except for Stepro's argument which seemed plausible at first. By the way, the German Wikipedia article quoted by Stepro lacks citations in this paragraph, so it's a bit hard to check what exactly the experts said in the Calatrava/Foster dispute. This only shows that they have a usage right, meaning the right to use this photo for this billboard. They would need the entire usage rights in the dome design for us to keep the photos with their permission (instead of requiring the architect's permission).   • keep: Limited access does not preclude the interpretation of a site as public. The usual example in German law books are cemeteries, that are closed at night. Despite the closure, they are considered public with regard to FOP. The roof was wide open to the public without booking before 9/11, you just had to show a photo ID and walk through an X-ray-scanner, so all pictures before that date should be fine. Since 9/11 the rules for admission changed a few times. But they were imposed for security reasons only, not for a general limitation of access. Please put it on hold, as Ukrainian laws do not contain clear explanation of FOP issues: they neither clearly forbid (only reproduction in the form of buildings and sculptures is forbidden) nor clearly allow reproduction. To support WLM contest, Wikimedia Ukraine is currently discussing the legal status of FOP in Ukraine with lawyers, and one particular reponse (from Institute of Media Law) states that recomendations of the Government of Ukraine do exceptions (including commercial use) for photos of objects located on central streets, roads, parks and other public places. We are currently working on this issue and it is quite possible that Ukrainian legal practice does allow publishing such photos under free licenses. Now relisting. Ukrainian government did not heed the call of Wikimedia Ukraine to have full FoP implemented in the country, and instead gave them a disappointing non-commercial FoP in December 2022 that does not conform with Wikimedia's acceptable licensing.

This image can be taken down now, as a violation to sculptor's (posthumous) copyright. w:uk:Пам'ятники Кропивницького#Колишні пам'ятники tells us that it was erected in 1970. Removal in 2017 does not magically take away copyright from the heirs of the sculptor. Since the date is 1970, it is at worst eligible for U.S. copyright due to Uruguay Round Agreements Act. URAA is typically ignored if a country has valid commercial FoP, something Ukraine does not have (and I assume will never, ever have, considering the Ukrainian government's unwelcoming response to Ukrainian Wikipedians/Wikimedians in terms of FoP matter). This statue is located in a fenced off area of a school yard and the photographs of it weren't taken from a public street or the like. Per Commons:Copyright rules by territory/Germany#Freedom of panorama for something to qualify for FOP in Germany it has to be either located in a place that is "sufficiently" dedicated to the public, or the photograph has to be taken in a place that is. If publicly accessible station halls, subway stations, departure halls, museums, public collections, churches, or administrative buildings are not considered to be "sufficiently" dedicated to the public qualify for FOP, then there's no reason a sculpture located in a fenced off school yard would either. So these images should be deleted as COPYVIO unless someone can provide evidence to the contrary.

The exterior (you quote interiors) of a public school in Germany is a public space, no matter if it is fenced off or not, even if the gate is closed for period of time. Schools are regularly used as voting places, for sports outside the school curriculum and other events for the public. School grounds actually aren't considered public places in Germany for purposes of FOP. At least not on Commons. Although I don't think they do legally either. Otherwise I wouldn't have nominated the images for deletion. Regardless, if you want to read up on the subject there's this deletion request from last year where a couple of German users who are very knowledgeable about the subject go into why they don't. Just an FYI to, one of the main reasons why the school didn't qualify as a public place in that case is because there was a fence around it.  Weak delete I'm not sure how public this schoolyard actually is. I have argued before (in Commons:Deletion requests/Files in Category:Wandbemalung Katholische Grundschule Windthorststraße which Adamant1 is referring to) that that particular schoolyard was not sufficiently dedicated to the general public because it was closed off on all sides with walls and fences. The difference to the cemeteries / graveyards regularly used as examples in legal literature would be that while cemeteries usually have walls and fences too, they are considered to be for the general public, but a schoolyard is intended for the people going to school there or working there. Depending on the situation, this could still be a sort of public place because it is also serving as a public thoroughfare or similar, but I don't think this has been demonstrated for this particular schoolyard so far. --Rosenzweig τ 07:27, 23 November 2023 (UTC)Reply[reply]

Hallo Rosenzweig, die Skulptur befindet sich im Eingangsbereich der Schule, auf dem Vorhof an der Ecke Langbargheide / Moorwisch. Das innere Schulgelände beginnt erst nach den Durchgang zwischen Verwaltung (östlich der Statue) und Klassentrakt (nördlich der Statue). Es ist richtig, dass um das Schulgelände ein Zaun verläuft, schließlich ist die Schule Langbarheide eine Grundschule. Das Tor ist aber auch außerhalb der Schulöffnungszeiten offen, weil die Sporthalle im Norden des Schulgeländes durch Vereinssport genutzt wird, u.a. vom Sportverein Lurup Hamburg von 1923 und der BSG Philips LG. (Siehe Belegungsplan für Schule Langbargheide 40 EFH in Hamburg-Lurup) So bin ich näher an die Skulptur herangegangen, durch das nachmittags und abends immer offene Tor. Die Widmung der Statue für die Öffentlichkeit ergibt sich schon aus dem Ankauf durch die Hamburger Baubehörde 1959 im Rahmen des Programms "Kunst am Bau". (Dazu Hamburgische Bürgerschaft, 21. Wahlperiode (Hrsg.): Kunstwerke im öffentlichen Raum, Schriftliche Kleine Anfrage vom 7. August 2018. Drucksache 21/13978, S. 23.) In der Gesamtschau von öffentlicher Zugänglichkeit und Widmung des Kunstwerkes für die Öffentlichkeit ergibt sich für mich ein klares Behalten.
Zudem entsteht dem Ansehen des 1964 verstorbenen Bildhauers Richard Steffen durch diese Art der Dokumentation kein Schaden, im Gegenteil. Auch eine finanzielle Schädigung des Nachlasses kann ich nicht erkennen - es ist keine Reproduktion eines zweidimensionalen Werkes, niemand wird auf den Kauf einer Steffen-Skulptur oder eines Nachguss verzichten, und sich statt dessen ein Foto aus Commons an die Wand hängen. Mir ist klar, dass wir in Deutschland kein "Fair Use" haben. Aber alle Faktoren würden hier für ein Zulassen sprechen: Ein Foto einer dreidimensionalen Skulptur ist umgestaltende Nutzung und hat wenig Bedeutung für dessen weitere Nutzung, die Absicht ist Bildung und zudem hat es - wenn überhaupt - eine positive Auswirkung auf Wert und Verwertung des geschützten Werks. --Minderbinder (talk) 08:10, 25 November 2023 (UTC)Reply[reply]
OK, du argumentierst letztlich, dass das Schulgelände nicht nur den Schulangehörigen, sondern der Allgemeinheit gewidmet ist wegen der Nutzung der Sporthalle auf dem Gelände und dass deswegen Panoramafreiheit gegeben ist. Kann man so sehen, soll der abarbeitende Admin entscheiden. Deine Ausführungen zu Finanz- und Ansehensschaden betreffen die gesetzlichen Regelungen zur Panoramafreiheit allgemein und sind m.
