Files in Category:Swiss Army Knife (Hirschhorn)[edit]

Thomas Hirschhorn is still alive and the works are exhibited in a museum in Switzerland. Commons:FOP Switzerland does not apply for the interior of buildings.

Paradise Chronicle (talk) 08:18, 21 October 2023 (UTC)Reply[reply]

Cordialement M. Schweizer 213.55.220.112 12:58, 21 October 2023 (UTC)Reply[reply]
I believe not the former nor the current director of the Museum have a say about the copyright of the building as they are not their architects. Then there is also the works of art of Thomas Hirschhorn, which in my opinion would need another permission as he is still alive and the art was not displayed at a space permanently accessible to the public. Drawings by user Maitane Azurmendi[edit]

Several drawings uploaded by Maitane Azurmendi are very similar to photographs which can be found on the Internet and are not in PD or not properly licensed. The user seems to be unaware of COM:DW rules, given the fact that even when the original picture is already uploaded to Commons and free licensed, she does not acknowledge it (see this case). I enlist some of the files and, besides, the corresponding images by which they were heavily inspired:

  • and more...

There are already other deletion requests going on: see this and this. And the number of drawings seems to be growing by the hour. I tried to reach the user on her talk page but she did not reply. I do think, however, it would be easier to solve this issue if she were to agree to pointing out other cases. Kind regards. Alavense (talk) 11:52, 21 October 2023 (UTC)Reply[reply]

Comment The source of the derivative works (at least all that I checked) are old photos from Spain. The copyright protection for simple photographies is 25 years, so unless URAA or another bilateral agreement between Spain and the United States, these drawings are derivative work of public domain works. Günther Frager (talk) 15:03, 21 October 2023 (UTC)Reply[reply]

Keep Per Günther Frager. The ones I've checked seem clearly older than 25 years. Acknowledging the PD source would be good, but lack of it isn't a reason to delete.--Pere prlpz (talk) 21:31, 21 October 2023 (UTC)Reply[reply]

It's not that simple. {{PD-Spain-photo}} may allow some of these but nor all. It's unclear what a 'simple photograph' means, and it is unclear that these photos were first published in Spain more then 25 years ago. Many of them are of Basque people, who may come from France.
I have identified a few more files which have the same issue (I have not investigated them all):
  • I did not find original credits in a short reverse image search, but photo has been widely online since 2014. Unless the original photo can be demonstrated to be free licensed or PD, the drawing should be deleted as DW. -- Infrogmation of New Orleans (talk) 17:28, 30 October 2023 (UTC)Reply[reply]
There is a potential issue with scope - if a file is a simple recreation of a public domain photograph then for almost all purposes the original photograph would be preferred to the recreation. However, the Basque Wikipedia article on the artist (w:eu:Maitane Azurmendi) should probably override this.

  • The Wall Street Journal still uses images like these, no reason why we cant have both the original and these stylized images. --RAN (talk) 04:06, 23 October 2023 (UTC)Reply[reply]
  •  Delete File:Béatrice d'Irube.jpg, reverse image shows it on French websites, not Spanish law. This series of drawings appear to all be COM:DW based on specific individual photographs - in all cases the source photo should be credited, and any where the source photo cannot be shown to be PD should be deleted. -- 17:17, 30 October 2023 (UTC)

Files found with Special:Search/insource:"90lineas.com/2022/09/01/sumo/"[edit]

These images are not in the public domain in Argentina. The source states that these photos were taken by Darío Almeida in 1986 but never published until 2016. First in Facebook and later in the magazine "Soy Rock". To be in the public domain in Argentina it needs to be created at least 25 years ago, and published at least 20 years ago. The former is meet, but not the latter.

File:Rodrigo Bueno as a Child.JPG[edit]

There is no evidence that this image was published at least 20 years ago, as required in Argentina. It is unlikely that a picture of a child would be published until he became a star, much later. .     Jim . . . . (Jameslwoodward) (talk to me) 14:41, 20 January 2013 (UTC)Reply[reply]

As the it reads under the picture's description, the photo comes from the archives of La Voz del Interior. As a child, Bueno was depicted on issues of the newspaper. He was not famous in Argentina, but within Córdoba city, during his pre-teen years he performed on live appearances of the band Chébere (popular on the area during the mid to late 70s). La Voz del Interior wrote a small piece about him during one of this guest performances (the photograph was published with the article). There is another picture as well from the archives, Bueno is depicted during the show Fiesta de Cuarteto at age two.
