Files in Category:Universitätsbibliothek Basel[edit]

The architect of the library is Otto Senn who died in 1993, interior spaces are not included in FoP-Switzerland. And Switzerland has a standard of life plus 70 years. Commons:Copyright rules by territory/Switzerland. I suggest to undelete in 2064. Some interior views I did not nominate for deletion as I did not really see something architectonical special in it, but if someone does, I suggest for them to do an additional DR.

Do yo mean the ones of the Freihandarchiv? That could be, but not the interior view of dome and stairway. Here is an article from 1968 about the building after its inauguration in an architectonic journal with a pretty detailed map that includes the dome and the several learning halls. Part of my answer concern also the Freihandarchiv because I took a bit longer in my answer. I believe it's good we discuss the files. Here, here and here some DRs where files were deleted with similar rationale that FOP Switzerland is not valid for the interior of buildings. I don't think there's any reason to delete the interior photos from the open archive (Freihandarchiv). Because this old building was designed by Emanuel La Roche (1863-1922). FOP of Panorama in Germany doesn't allow for temporary works and per the description for these images "A male bronze sculpture was temporarily located under the subway viaduct at Rödingsmarkt in Hamburg's old town." So these images should be deleted as COPYVIO unless someone can provide evidence to the contrary.

I have zero clue what your talking about or how its related to the DR. But the statue was clearly meant to be temporary. So this seems like a pretty open and closed case to me. Otherwise it would be cool if you stated why I'm wrong instead of just capitulating about how I'm bothering people or whatever. I can guarantee whomever closes this isn't going to keep the images just because your annoyed by the deletion request. Denk einfach mal darüber nach, wieviel unnötige Zeit Admins auf Commons nun verschwenden müssen, um über Deine unsinnigen Löschanträge zu entscheiden. Wärest Du so korrekt im Einhalten der Regeln hättest Du erstmal geprüft, ob der Künstler dieser Skulptur diese nicht doch zum dauerhaften Verbleib dort aufgestellt hat und somit sehr wohl unter FOP fällt. Diese Skulptur wurde schließlich nicht vom Künstler selbst entfernt sondern sie wurde umgesetzt auf Weisung des zuständigen Bezirksamtes zum Schutz vor Zerstörung durch den dortigen Verkehr und an einem besser geschützten Ort aufgestellt. Und vermutlich zum dauerhaften Verbleib. Wie lange der dauerhafte Verbleib allerdings sein muss spielt dabei keine Rolle.Ich geh mal davon aus, dass Du den Künstler selbst dazu befragt hast bevor Du Deine Löschanträge in Bezug auf diese Skulptur gestellt hast - oder etwa nicht ? Ansonsten solltest Du belegen, dass der Künstler für diese Skulptur von vornherein nur vorübergehend einen öffentlichen Standort gewählt hat, aber ich glaube nicht, dass Du das belegen kannst. Entscheidend ist außerdem nicht der Standort, wo sich eine Skulptur befindet, sondern dass sie geschaffen wurde, um dauerhaft der Öffentlichkeit präsentiert zu werden und nicht nur vorübergehend. Und ansonsten müsstest Du für etliche Bilder, die bei irgendwelchen Ausstellungen entstanden sind ebenso Löschanträge stellen, aber dann wird wohl jedem klar werden, dass Du den Sinn von Wikipedia und ihren Projekten und auch die Deutsche Rechtsprechung nicht verstanden hast. Why don't you ask the artist for them to give us permission to host the images on Commons if you care about it that much? Also, this isn't Wikipedia. Nor is it a "Wikipedia project." At least I know what website this is despite all your talk about how ignorant I am lol. Anyway, no one anonymously places a statue on the middle of the sidewalk as some kind of street art project under the assumption that it will be there permanently. Nor is such a work ever permanent either. But again, this could easily be solved by the sculptor giving us premission to host the images. Per Commons:Copyright rules by territory/Germany "Whether a place is "public" for purposes of § 59(1) does not depend on whether it is public or private property. Instead, the question turns on its actual accessibility, which, according to the prevailing view, needs to be such that one can infer a (sufficient) dedication to the public." In this case the statue is on the fenced off grounds of a museum, which by the virtue of the fencing and fact that it isn't a public street, way, or open space means it isn't "sufficiently" dedicated to the public enough for photographs of it qualify for freedom of panorama. There's also zero evidence these particular ones were taken from the street or another public place. So the images should be deleted as COPYVIO unless someone can provide evidence to the contrary.

  • Ich habe die Aufnahmen "Hamburger Bahnhof - Museum für Gegenwart 01.jpg" bis "Hamburger Bahnhof - Museum für Gegenwart 08.jpg" vom öffentlichen Gehweg vor dem Musuem (52.52764,13.37285) gemacht, um Bilder von öffentlichem Grund nach Panoramafreiheit zu erhalten. Dabei habe ich die Zoom-Funktion der Kamera verwendet.   • I would think that a museum by definition was “dedicated” to the public. A fence to protect it from illegal entrance outside opening hours is a not uncommon sight at museums in Germany and elsewhere, but it does not diminish the public function a museum has. I rather not get in a debate about it, but actually generally speaking museums in Germany aren't considered "dedicated" enough to the public for FOP. What we are really talking aabout here though is the outside of the museum and if the grounds around it are "dedicated" to the public enough to be considered something like a public street, way, or public open spaces. At least going by Google Street View the grounds are behind a gate that seems to be locked during the day, or at least it was when the images were taken. So the grounds around the museum inherently can't be an "open public space." To quote the guidelines "private property that cannot be freely accessed, for instance because there is some type of access control in place (or even an entrance fee is charged), does not fall under § 59(1)." It has nothing to do with the opening hours of the museum though.   • Da ich einen Hinweis erhalten habe: Der "Hamburger Bahnhof" (in dem sich heute das Museum befindet) heißt so, weil es der Bahnhof in Berlin war, von dem die Züge nach Hamburg abgefahren sind. Und das Tor, das sich vor dem Gelände des heutigen Museum befindet ist offen während der Öffnungszeiten des Museums (was für meine Bilder aber schon deshalb keine Rolle spielt, weil meine Kameraposition höher war als das Tor.). I still don't think it matters since usually gated off areas aren't considered "sufficiently" public enough anyway. If you want an example, there was a DR awhile back having to do with a German school, where the images were deleted because the school had a fence. Obviously schools have opening hours just like museums do, but it doesn't matter. Hence the word "sufficiently." The only exception for fenced off areas seems to be graveyards. But they are an exception for a reason, because in most other cases fenced off areas that are generally closed during none business or otherwise restrict free flow to the public don't qualify for FOP. --Adamant1 (talk) 13:23, 22 November 2023 (UTC)Reply[reply]
Um es noch mal klar zu machen: Ich habe kein Stativ benutzt, keine Drohne, keine Leiter, keinen Stuhl. Ich habe keine Äste abgeschnitten oder weggebogen. Ich habe mit den Schuhen auf öffentlichem Grund gestanden, als ich die Bilder gemacht habe. Dass sich die Kameraposition aus der Perspektive errechnen läßt, habe ich bereits geschrieben. Ich habe noch weitere Bilder von der Front des Hamburger Bahnhofs, die ich noch nicht publiziert habe, aus denen der Kamerastandort aber klar ersichtlich ist. It was more a general comment more to do with what you said about the fence probably being locked during COVID then anything having to do with any particular images. Although now that you mention it, I was probably going to remove File:Hamburger Bahnhof - Museum für Gegenwart 08.jpg. But I don't really like the tone. Especially you saying "everything will be much easier" if I do it sounds needlessly threatening. So I think I'll just leave it up to the closing administrator. Although there is someone else photographing the statue from close up in the image already. So I don't know why you wouldn't have done the same thing. But again, I leave it up to whomever closes this to the do the proper calculations of the camera position or whatever to determine if the image should be kept.  Keep If the images where really taken from the public road, then any fence or similar is irrelevant. Anything visible from a public place is under the FOP rule, it doesn't matter where the object itself is. I do not recall if I opened a door in the fence (that could bew closed to keep stray dogs out and foir similar practival reasons), but I got into the garden without any trouble, Google notwithstanding. No offense, but your personal experience has nothing to do with if it's a public place or not since it's possible they just opened the fence during the time that you took the photographs, but it's usually closed. The gate can obviously be closed most of the time and you could still have walked on the property to photograph the statue when it happed to be open. They aren't mutually exclusive. Nor would it somehow mean the photographs qualify for FOP just because you were lucky enough to be there when it was open for some reason. Тоже самое южные части Дербентского района, где лезгины состовляют около 80-90% также не отмечено. В Кабалинском районе по официальным данным переписи 2009 почти более 15 тыс лезгин, а на карте олно пятно и тд. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Ukraine.

  • Delete - There is a phone number on the bottom of the bceagles.com photo - "1-800-317-8207". Googling that number, it belongs to "Aerial Photography by Don Couture". The original uploader's name is User:Kempthorne. Presumably, Kempthorne is this uploader's surname, which means he is not "Don Couture". And if we look at all of the images they uploaded on :en, they are all different sizes and probably all copyright violations. File:Alumni Stadium 2005.jpg seems to be the only one still around and it should be deleted too. I have no idea whether or not bceagles.com was the original source (certainly something uploaded to bceagles.com in 2015 was not the original source of something uploaded to Wikipedia in 2006). @Jmabel: Do you have a cite for that? You may be thinking of the fact that Congressmembers get their own budget and a lot of independence in how they hire, manage their staffs, and set salaries. But the Congressmembers are federal employees, deploying federal money to hire people to work under their direction to carry out their official duties. I have enquired with Parliamentary Services whether they could make individual photos from this shield available to WM Commons as there are many MP bios where we don't have a photo. Their reply was as follows: "Unfortunately we don’t hold any right to reuse those images from the 53rd Parliamentary Shield. The images of the Members came from the Political Parties so they would hold the copyright of those images and would have to give approval for the to be made available for individual images."

Therefore, the images themselves don't fall under the CC-BY notice on parliament's website. Hence, the license as provided is wrong. Which leaves the question whether we could claim "de minimis". I'd rather see this file deleted TBH. Schwede66 21:55, 22 November 2023 (UTC)Reply[reply]

Which site? This picture is taken from official site of croatian goverment (https://www.sabor.hr), where it says that all content that is created by hrvatski sabor is free to use without further modification.
