FOP Switzerland does not apply for interior places. It is generally held that the interior of a church cannot be depicted under Article 27. The church's architect was Karl Higi who died in 2008 and Switzerland has a standard of life plus 70 years. I suggest to delete now and undelete in 2079.

Posters taken from the book "76.11 afiches. Momentos que hicieron historia" published in Argentina in 2011. The book was published by the Argentine Education Ministry and it is available online [1]. The has the tag {{Copyrighted free use}} that I think it is incorrect. The copyright text in says: "Prohibida su venta. Se permite la reproducción total o parcial de este cuadernillo", that means "Selling is forbidden. Reproduction total or partial is allowed". It is clear the simplest commercial use of selling this work without any modification is strictly forbidden, and there is also no explicit mention of derivative works. There is another problem: these posters are the intellectual property of different human rights organizations. The book itself is a commentary of the posters and their historical background, and one can argue that the inclusion on the book is a typical case of de minimis. Isolating images is such case is not allowed.

Files uploaded by Gcitizen and socks[edit]

These files were already rightly removed by Wutsje as G10 or F10. They were then restored because of permission but the problem was not permission in the first place, the problem was they were spam. Like Wutsje wisely said "spam is spam regardless of permission". It's a cross-wiki spam from someone with many globally locked socks. All of the attempts to spam on all projects except here are already deleted, meaning it's not notable as determined by all projects. --Tehonk (talk) 04:30, 27 October 2023 (UTC)Reply[reply]

  •  Comment Wikipedians weren't satisfied by the sources used for citations, but there are a goodly number of search results. I would consider him notable enough for Commons, but I fully expect that I just wasted my keystrokes and everything will be deleted per nom. -- Ikan Kekek (talk) 07:17, 27 October 2023 (UTC)Reply[reply]
Search results don't mean anything, the results are mostly spam, paid, SEO links, etc. Commons exists to serve Wikimedia projects, if the consensus on every single project is that it's not notable and cross-wiki spam, then it's not notable and out of scope. Commons is not a place for advertising or spam. And also this is not really a place to determine notability. Tehonk (talk) 21:06, 28 October 2023 (UTC)Reply[reply]
  • Commons does have some kind of standard of notability. If it didn't, how would we choose which photos of dogs, cats or, say, chairs to keep or delete? Anyway, I think the closing admin will agree with you that because there's no Wikipedia article about this company, we should delete all of these files, but I think some might be useful and could be kept. -- Ikan Kekek (talk) 00:13, 29 October 2023 (UTC)Reply[reply]

Unfortunately FOP in Switzerland doesn't include interior views and the architect of this building, Alvar Aalto, died in 1976. So these images are copyrighted until at least 2047.

Adamant1 (talk) 12:33, 27 October 2023 (UTC)Reply[reply]

Thanks.
I just would like to comment, as person who concluded a Creative Commons Certification for GLAMs, that:
1. these photos are so low-quality and in so much into darkness that no lawyer in the world could try to discuss about any potential economic harm from any use of these pictures in the world, after these were shared by the Museum and Wikimedia Commons. There is no known historical case about such ugly and dark photo reclaimed from an architect and reclaiming economical damage and/or winning that lawsuit. So, this is totally under fair-use to me in good faith.
2. the Iconoteca dell'Accademia di Architettura di Mendrisio is a trusted organization and clearly indicates a Free license. As Wikimedia Movement, we should keep our eyes open, but we should not play with the rules to express our political orientation (that is, we know, we want FOP in Switzerland - so, we are in conflict of interest at the moment - this may be nice for us, and I would agree to share that political line, but unfortunately this deletion will be unnoticed by every political person in the planet, and, the architect, so, we will just lose a Free photo).
3. Nobody in the world has a proof that the museum has not followed their copyright processes. We have no indication of the contrary. So, we should avoid to trigger a deletion request, if we are not the copyright holder of these low-quality photos.
4. the copyright holder, can, and always has been, able to leave a comment in the talk page, or open a ticket to share complaints to VTRS, or write a blog post on their website. That never happened.
Indeed, my comment will be archived and this photo will be deleted :) By the way, I hope my comment was still interesting to read. Thanks --bozz (talk) 13:09, 27 October 2023 (UTC)Reply[reply]
Yes an interesting read in indeed and I appreciate that you stuck to the facts without making the comment personal. If your allow me a few counter points though.
1. Maybe it's your monitor settings, but I can make out the architecture of the building in all three photographs despite their darkness. Especially with the second photograph, which isn't even that dark to begin with. Shaded, sure, but the claim that it's so dark and low quality no one could make out the details of the building is clearly false. That doesn't even take into the ability of lightening the photographs through image editing software either.
2. I don't doubt that the organization released the photographs under a free license. That's different then if the building depicted in said photographs is copyrighted though, which is what this DR is about. Not the copyright status of the files. The idea that they have full time legal staff that carefully check what's depicted in every single photograph that comes into their collection for possible violations is completely unfounded in reality. Most GLAM organizations don't know or care about the copyright status of works in their holdings. Let alone do they review images to make sure nothing in them is copyrighted. Also, this has nothing to do with anything political and I'd appreciate if you left politics out of it next time.
3. Again, this has nothing to do with the copyright status of the photographs, but the building in said photographs being copyrighted, which I was pretty clear about in my original message. The architect of the building obviously can't and never will write a blog post or get VRT permission for us to host images of the building because they died in 1976. Nor will whomever owns the copyright now probably either. So your suggestion that totally moot. Also COM:PCP "The copyright owner will not bother to sue" applies.

Unfortunately there's no FOP in Italy and the architects of this building, Alvar and Elissa Aalto, died in 1976 and 1994 respectively. So these images are copyrighted until at least 2082 2046 due to the lack of solid evidence about the degree to which Elissa Aalto was involved in the project. Otherwise 2082 if any materializes.

Adamant1 (talk) 12:39, 27 October 2023 (UTC)Reply[reply]

@Adamant1 I think that you mixed two churches... This is the one by Aalto and copyrighted only until 2046 (I couldn't find any hint of a role by Elissa Aalto). The church designed by Giacomello is this one. Friniate (talk) 19:17, 27 October 2023 (UTC)Reply[reply]
Wierd. I know there was a DR where I wrote the church was built by the Aaltos. Now I got to figure out which one it is. I'm not to hung up on what role Elissa Aalto played in the design, but it is connected to her category, which I assume there's a reason for (I don't think just because you couldn't find anything means she's not connected to it somehow either. But again, I'm not hung on the specifics of the undeletion date either. Maybe something about it will materialize between now and 2046). --Adamant1 (talk) 19:44, 27 October 2023 (UTC)Reply[reply]

Not included in this nomination is File:Mike Smith Blur.jpg which was uploaded as own work but is a duplcaite of another file already uploaded to Commons from Flickr.

Hello sorry I'm doing this wrong - I can see on the Wikicommons upload how to show when you're uploading something that's someone else's, but not how to attribute when you upload during editing. So you know I'm not doing this nefariously deliberately, on the Mike Smith pic, the source (Mike) gave permission for me to upload. On the logo and photo, the MS Society UK brand team gave me permission to upload (Head of Brand Vix Proctor) Jasmine Rodgers gave permission for her pic and the Flickr account the other Blur pic is from is marked for reuse with attribution. Is this something I can edit within commons or do they all need to be deleted and re-uploaded? Babski (talk) 15:51, 28 October 2023 (UTC)Reply[reply]
The copyright holder needs to declare that the image is under a free license. Proof of such a declaration must be provided. See Commons:Email templates for a template of what the copyright holder must send in to the Volunteer Response Team. -- Whpq (talk) 14:16, 29 October 2023 (UTC)Reply[reply]

Files found with Special:Search/Olympic Flame during the 2020 Summer Olympics opening ceremony.[edit]

The Argentine government doesn't hold the copyright of this image and therefore they cannot license it. The image appears in several newspapers, for example this ESPN article published 8 days before credits the photo to Geoff Burke/USA TODAY.

Günther Frager (talk) 16:05, 27 October 2023 (UTC)Reply[reply]

Just a note: these images on Commons and ESPN are not the same ones; different time, position and angle. Apparently taken from a place for photographers, so even the same photographer is uncertain. I don't know the Argentine licensing issue. I have no problem with deletion. Kacir (talk) 22:33, 14 November 2023 (UTC)Reply[reply]

Yes, you are right the ESPN image is different. However, if I'm not again mistaken it is the same as this one (warning it downloads the image) from ITF, originating from this article. The Argentine website has a site-wide CC-BY license, but they almost never cite their sources. A similar issue using the same page is Commons:Deletion requests/Files found with insource:"Naomi Osaka at the 2020 Summer Olympics". Günther Frager (talk) 23:18, 14 November 2023 (UTC)Reply[reply]

File:Prime Hydration Flavours 2.jpg[edit]

Design is probably OK, but the license is not (yet). Yann (talk) 20:55, 27 October 2023 (UTC)Reply[reply]

The issue with this is in the fact it was released as public domain by the person who took the photograph of copyrighted objects whose copyright they clearly do not own. https://commons.wikimedia.org/wiki/Category:Packaging? talks about copyright on packaging. Since the design of the containers is the subject of the photograph, I don't believe deminimis is applicable here. The bottle on the far right clearly meets the threshold of originality. The fourth white bottle could arguably meet originality too because of design within the lettering. https://commons.wikimedia.org/wiki/Commons:Threshold_of_originality Graywalls (talk) 04:03, 28 October 2023 (UTC)Reply[reply]
Some of the designs may be under a copyright, yet the picture may be OK if we consider that the complex design(s) is/are de minimis. Yann (talk) 16:46, 28 October 2023 (UTC)Reply[reply]
I'd have to disagree in this context, because it's part of the focus of the image. If it was say a piece of art that was on the wall in the background (totally not the focus of the photo), you'd have a point. Graywalls (talk) 00:53, 30 October 2023 (UTC)Reply[reply]

According to the image description, the man depicted in it is a certain “André Koehne”. It turns out that the name of the uploader is also André Koehne. Since the photograph is not a selfie, it is evident that the image is not the “own work” of the uploader (André Koehne), so permission should be required and verified by a VRT volunteer—otherwise the file must be deleted. 191.56.146.160 23:41, 27 October 2023 (UTC)Reply[reply]
