Tried to use my own images for Wikipedia but identified as copyright violation[edit]

AbchyZa22: empiezo a tener serias dudas de si conoces la diferencia entre las palabras «descargar» (download) y «subir» (upload). ¿Por descargar te refieres a guardar la imagen en tu computadora o celular? Efectivamente, no hay ningún problema con eso. "Wikimedia" de forma general nunca te va a poner pegas a descargar una imagen ya existente en Wikimedia Commons. Si te estás refiriendo, en un mal uso de la palabra 'descargar', a que si puedes "subir" a Wikimedia Commons imágenes de papeletas electorales porque otros lo han hecho, te diría que el que enlazaste es un mal ejemplo del que tomar 'inspiración': es improbable que se trate de un "trabajo propio" de quien subió la imagen y habría que establecer, por tanto, motivos por los que dicha imagen podría considerarse en dominio público (pueden existir, pero yo los desconozco). AbchyZa22: ya te he dicho que, dado que no es una creación tuya, tienes que especificar algún motivo por el que la papeleta estaría en dominio público. ¿Carecen las papeletas electorales de Venezuela de derechos de autor por alguna ley venezolana? ¿existe algún otro motivo por el que podría considerarse en dominio público (de minimis, umbral de originalidad o algo así)?: lo desconozco, ni soy venezolano, ni soy experto en papeletas electorales, ni he manejado muchos casos de minimis u originalidad). Con la información que has proporcionado te diría que no subas la imagen, pero es posible que obtengas opiniones más cualificadas que la mía en COM:VP/C (aunque te recomiendo que te expreses con más claridad, cuesta entender lo que escribes incluso a un hispanoparlante, y allí se prefiere el inglés). Image created by me but based on an historic image provided by the British Library[edit]

I obtained some images of pages of a book printed in 1650 from the British Library's Imaging Service. These I edited so I could use them to create a single folio image for my own purposes. The result is therefore my own work, based on copies from a 1650 book which is obviously out of copyright. Can I submit it to Wikimedia? Can the terms of the BL Imaging Service affect this? (I can't check it just at the moment as their website is inaccessible.) Ceperman (talk) 18:15, 12 November 2023 (UTC)Reply[reply]

@Ceperman: if these are faithful copies at each step of the way, then as far as Commons is concerned these are simply uncreative photos of a two-dimensional work in the public domain, and may be uploaded as such ({{PD-old-100}} or similar tag). Neither you nor the British Library has any copyright involved here.
Note that UK law may view this differently: there is a so-called "sweat-of-brow" doctrine in UK copyright law if it took a lot of work to make the clean copy. I believe (though I could be wrong, User:Clindberg might know) that it has never been tested in a courtroom. Commons pretty much ignores it. - 22:40, 12 November 2023 (UTC)Reply[reply]

As I said, Commons really doesn't recognize the "sweat of the brow" claim. The only concession that I'm aware we've made to it is that there are some UK GLAMs who freely provide us with reasonably high-res content on the basis that we don't host their super-high-res versions of the same content. - Jmabel ! talk 19:44, 16 November 2023 (UTC)Reply[reply]

Je ne comprends pas l'azéri mais il semble qu'elle soit déclarée comme libre (GNU version 1.2 ou ultérieure).

1 - Quelqu'un peut-il le confirmer

2 - J'ignore comment on importe un fichier du Wiki AZ vers Wikidata. Ça m'intéresse si quelqu'un peut me l'expliquer (ou, au pire, faire le job à ma place...)

@Éléphant volant: Bonjour, Vu l'absence d'information sur cette copie sur az.wp, ce n'est pas une bonne source. La licence qui y prétendue est presque certainement une fausseté. La photographie est des années 1910. La copie de la même photo sur en.wp fournit l'information requise, la source immédiate étant la State Historical Society of Missouri (image), avec mention que l'original provient de The Reinhardt N. Ausmus Collection, Rutherford B. Hayes Presidential Center. Il vous faut copier le fichier sur Commons. Vous pouvez le faire facilement depuis la page de en.wp, en utilisant la fonction «Export to Wikimedia Commons». Why does this svg appear different than when it is converted to a png?[edit]

For some reason this image appears differently as a png and svg. Here is the png, if you open the svg (open the image onto Commons, then click on it), the yellow background shrinks in size, leaving a large portion of the background white. Why does this do that? @Panamitsu: This is an impressively messed-up file! I've fixed the issue where the style definitions were

and the issue where the contents of the image were 100000 times as tall/wide as the ostensible height and width. I'm not sure why the only shapes that display are the rectangle background and the three stars, but hopefully someone else can help with that. I'm looking forward to finding out what's going on there! Were you asked to donate while browsing Wikipedia? If so, please e-mail donate@wikimedia.org for any questions. The Wikimedia Foundation is the organization that collects those donations and uses them to operate Wikipedia and Wikimedia Commons. It has almost certainly nothing to do with this website. You're not telling billing by whom and for what. I doubt that anyone can help with something vague as "the billing thing". @VictorEdgar: but more to the point, assuming you are talking about a Wikipedia article, there is normally no need to upload a PDF anywhere to cite its contents. If the PDF in question is already online somewhere, cite the copy already online. If it is not, then it is presumably a scan of a printed source, which may be cited. Citations to not need to be even to materials that are on line, only to materials that are, at least in principle, available to be viewed by another person. E.g. look at the citations and references for Abraham Goldfaden. - Jmabel ! talk

Contrast enhanced ISS images[edit]

Am I doing this right? Does this look OK? I have another 16 of these ready to upload. I downloaded the digital negatives from NASA and adjusted them in darktable. The bottom right corner ends up a bit dark, because I'm subtracting the haze uniformly across the whole image, which exaggerates a slight vignetting in the source image.

@Tim Starling: You are doing fine. I wouldn't worry about your image not being in all ways better, that's exactly why we don't overwrite. Offhand the only things I'd do differently are:
  1. be overt about the retouching, something like "white-balancing by Tim Starling".
  2. assuming it is your intent to release the white-balancing into the public domain, be overt about releasing your enhancement with a {{CC-0}} tag or other similar means of waiving rights.

Updating/replacing a deletion request with no permission template?[edit]

I have nominated File:Mohd_Sany_Hamzan_sedang_berswafoto.jpg for deletion here. I am aware that missing EXIF data is not sole grounds for deletion and apologise for that. However, it is highly likely that this is not the uploader's own work as claimed on the page because it is a selfie of the subject. Did I create the logo? No but I am part of a school trying to make a Wikipedia page for our school. It is extremely difficult to do and not very user friendly. Is there any other way of making a page? I have also tried to put coordinates in my article but it won't show on the map.

@DelanoAcademyCanada: I'm guessing we are talking about the coat-of-arms-style logo at the upper left of https://www.delanoacademy.com/. That is almost certainly copyrighted (and trademarked). To host that on Commons, we would need a the copyright-holder to go through the process described at COM:VRT to offer a free license to use the image. That copyright-holder will be either the designer of the image or the academy itself (in the latter case we would need a representative of the academy to do the COM:VRT thing). Once you know that is moving forward, you can upload the image with Special:UploadWIzard, making sure to mark it with the appropriate authorship plus three tags: the relevant license (probably {{CC-BY-SA-4.0}}, {{Trademarked}}, and {{subst:PP}}.
If you cannot get the relevant permission, and you want the logo for an article on en-wiki, you can take advantage of their policy for limited non-free content. You would use en:Template:Non-free logo. Note that this approach does not involve Commons at all: you would upload to en-wiki, and the file you upload would not be accessible to Commons or the other sister wikis. - Jmabel ! talk 18:29, 17 November 2023 (UTC)Reply[reply]

This is the logo of the Canadian Baseball Network, the page of which I am in the process of creating on Wikipedia. However, I don't know what the copyright rules are for uploading photos of logos. I took this one directly from the website (here). I would appreciate the help. Thank you.

@Omnis Scientia: That website is "Copyright 1995-2023" per the bottom line. Also, per the Berne Convention and COM:Canada, since 10 April 1928 every copyrightable work created in Canada has been automatically copyrighted the moment it was fixed in a tangible medium of expression, so that logo is still copyrighted (at least since the website design in 1995). @Turwaq: In more detail: a link to your contributions page (Special:Contributions/Turwaq), which has all your edits, is next to the "Log out" button in the top toolbar, and you can also get there with the keyboard shortcut Control+Option+Y [⌃⌥y]. You can also go to your user page and click "User uploads" (Special:ListFiles/Turwaq) in the left toolbar, in the "Tools" section. (The toolbar may be on the right in the layout for RTL languages; I haven't checked.) And as @BananaSlug notes, you could, if you wish, edit your signature to link to either or both of these pages! I did this, by going to Special:Preferences#mw-prefsection-personal, checking the "Treat signature as wikitext (without an automatic link to your user page)" box, and typing in the wikitext I wanted for my signature.

auf meiner Benutzerseite wurde mir aufgrund o.g. Crop eine Sperrung angedroht. Ich habe bei der Diskussion diese files schon erwähnt, dass ich lediglich ein Crop von einem File, was mit CreativeCommons-Lizenz ausgezeichnet war, gemacht habe, und ich denke, dass ich als normaler User diesem auch vertrauen können sollte. Bitte diesen Verstoß enstprechend bewerten, mich aus der Verstoßliste nehmen und mir bitte Rückmeldung geben. Danke Euch schon mal! Hello, Unfortunately, some people upload non-free files with fake licences. Hundreds of files must be deleted every day. If you happen to make, although in good faith, a cropped version of a copyvio, unfortunately the result will still be a copyvio. Files on Wikimedia must be free for any use. @Wikisympathisant: Obviously, we cannot always identify promptly that an uploader has lied about a license. I'd guess that at any given moment between 0.5% and 1% of files on Commons have some sort of licensing problem, which is to say between 500,000 and 1 million of the 100 million files here. That's not easily fixed, but I think it is actually about the lowest percentage of any even vaguely comparable site on the Internet. @Wikisympathisant however, you are right with "can not trust in the CC-license". This is the case for every media at every platform: Whatever the description says can be wrong and copyright law everywhere says, the user of a media file is responsible for copyright infringements even if them had no way to know, that it is a copyright infringement. That is different from all other areas of law. If for example you bought a car and had reason to beleive it was legal but only find out that the seller had stolen it after you owned it for some year it is stil legally yours. With copyright it is the other way around: If your family has owned a piece of artwork for 50 years and than find out it was stolen you have to return it to the original owner. With copyright you are ever only on the save side if you created a work yourself or know the creator personally. I found these old photos of old (1980s) front pages from a now defunct newspaper, on a site called LibraryThing, which describes itself as free and open.

I get that this is less concrete than an image marked with an explicit modern CC license. But I'd like to know if the images will suddenly disappear from my Wikipedia article.


I have a similar concern with an image (https://commons.wikimedia.org/wiki/File:PLEXUS_Nexus.png) on my draft Wikipedia page. It is taken from the archive of the Berkeley Barb newspaper on JSTOR. How to internationalize signature[edit]

Inspired by a discussion above, I want to internationalize my signature. I went to Special:Preferences#mw-prefsection-personal, checked the "Treat signature as wikitext" box, and edited my signature to

Hmm, the box at meta:Special:Preferences says

Wikitext signature (if unchecked, the contents of the box has to be plain text, treated as your nickname linked automatically to your user page; if checked, the contents should be source code, including all links; templates etc., images, and external links are not allowed)

so it seems like the the automatic substitution is probably to prevent people from using templates in their signatures? I should have the ability to specify how I am credited under these photos. @グリーンベレー: three ways to do this legitimately. (1) The copyright-holder can open an account here and do their own uploads. (2) The copyright-holder can publish the photo and offer the relevant license on any web site that is clearly under their control (e.g. on Flickr, or on a public-facing social media page) and you can cite that page as the source when uploading. (3) The copyright-holder can write to COM:VRT either to release the relevant license for a specific image or images, or to give a general authorization that they trust you to upload and indicate licenses for materials for which they hold copyright. Note that in that last approach, they should be clear in stating that they understand that you will be posting and indicating irrevocable licenses; they can revoke their permission for you to post for them beyond a given date, but they cannot retroactively take back licenses that you have indicated on their behalf while you were their authorized representative.
Sorry you got blocked before this got sorted out.   2. We don't have an account called User:Mugojja edward bernes or User:Mugojja. Are you sure you are on the correct site?
  3. If you were blocked, then the only place that you can dispute that is your user talk page. You should not be editing other pages, even from an IP address, while blocked. If you were blocked from using even your user talk page, it was presumably because you abused the privilege of accessing your talk page while blocked.
  4. If somehow you are both blocked and something is wrong with your login (an unusual combination, but I guess it could happen) you still should be able to access your user talk page without logging in.
  5. You don't really have an "inbox" here on Commons: the wiki pages are publicly visible.
  6. If when you say you were "blocked" you actually meant something other than that your account here has been blocked, please explain more precisely. Your first link (Sales_scalable.png) gives "We are sorry, the page you requested cannot be found." I tried a few variants on the URL, but couldn't make it work. On your second link, I can't tell what image you might be talking about.

Picture[edit]

I am looking for a picture for the Morrisite War, I have found three pictures but I do not think any of them can be used. The first one you are able to buy but I do not know if wikipedia is allowed to do that. I do not know the copyright laws for the second one. I do not know how accurate the first two are as there was no report of a "massacre of the Morrisite" as government forces entered the area and arrested the leaders. The last one was a political cartoon but I also do not know the rules for the political cartoon. Overall if none of them are usable what is the best thing to do? @LuxembourgLover: The first one is from a book published in 1870 [1]. It's in the public domain and it's ok to upload a copy to Commons. There are copies on several websites. Upload preferably the best copy you can find. A use in Wikipedia depends if it's useful there. The third one is clearly recent, so presumably copyrighted. The second one: if the 1890 date is correct, it should be in the public domain in the U.S. It's clearly something that would have been made for publication, and promptly published. Hey, I came here from Polish wiki (editor). I'm not ready to upload or manage photos yet, and I understand that editor's duties are different here, so I checked out other tasks, notably management of Galleries. If I understand correctly they run parallel to "normal" Categories we know from wiki? Can I help in managing them right now without special user roles? And lastly, are they actually useful for Commons visitors? No sarcasm intended, some wiki stuff tends to be more or less practical. Tried to ask on IRC but... Galleries in the main namespace (not the galleries in the user namespace) are like Wikipedia articles: their usefulness may differ depending on various criteria, the topics, their state, the interests of different users, and you, and any other user, can edit them. Good galleries have a sound logic to them and use representative files. One example of a good gallery, IMHO, is Rosa. Other good galleries may have a chronology logic, different from the associated category, etc. Bad galleries pick files subjectively without logic or promote a particular user's photos. @InRRainbows: If the copyright warning is correct for the file fi:Tiedosto:Etelä-Tapiolan lukio logo.svg, then you need to make a copy of that file and upload it directly to en.wikipedia under the Non-free content policy. You can use the "Upload a non free file option". The other file, File:Etis.jpg is on Commons, so it can already be used without uploading another copy. For instructions on how to display images on en.wikipedia, see the help page en:Help:Pictures. Is this picture copyvio[edit]

I uploaded this file from a scrrenshot of the website of the original publisher, the al-Qassam Brigades of Hamas. Since other media outlets shared the picture I assumed it was released so that it is shared by others, but I couldn't locate the lisesnce on the website. Is that considered copyvio, because on the bottom of the site they have the general statement "all rights reserved" without further clarification. Expired Patents of MP3[edit]

Hello. I wonder why MP3 loadings are still unwanted. I wonder this, because MP3 patents are expired. EN Wikipedia says this. And, there is my reason to want load MP3's: MP3 is more widely supported than OGG, OPUS, and etc; so it will be more compatible with for example old browsers. I know WAW is more compatible than MP3, but WAV files are generally bigger because it does not use compression. I think MP3 is a good compromise between size and compatibility. @Gologmine The copyrightholder, which is usually the photographer, needs to release it under an acceptable license (Commons:Licensing#Well-known_licenses). Unless the image is clearly marked as such on social media/webpage (rarely the case but it can be done), the copyright holder can mail a confirmation of licensing to Commons, instructions on that at COM:VRT. Automatic Transcode[edit]

Hello. I asked to this help desk today for same file, and now i have another problem. Commons automaticaly creates two transcodes, and they have unsuitable values. It creates a MP3, and its sample rate is 44100Hz, but it should be 22050Hz. OGG transcode contains the same problem. Also, they have very high bitrates, for example MP3 is 116kbps VBR but it should be maximum 80kbps CBR. Also, another problem: MP3 and original file are stereo, but OGG is mono. They should either be all stereo or all mono. What can i do to solve this problem?

you will only see one photo for the Clifton Hill Historic District.
But I uploaded all these photos: Category:Clifton Hill Commercial Historic District
Usually someone categorizes them for me and they will show up on the listing under More Images.

@SharonPapierdreams: It took me some time to figure out what you were talking about. It seems you are talking about some list articles in the English-language Wikipedia. There's always only one image displayed for each entry there. When a related category on Commons also exists, it can be linked. To take one example: In en:National Register of Historic Places listings in Ellsworth County, Kansas, if we look at the edit box, we see that some entries are linked to the Commons categories by the addition of a parameter "|commonscat=" followed by the name of the category. So, to the entry "Ira E Lloyd Stock Farm", if we add the line "|commonscat=Ira E. A supposed inaccuracy in my map[edit]

Depsite the fact that I based my map :

on two actual maps, this user @M.Bitton still claim that my map is original research I tried to reach out with him on the issue, he responded with closed eyes, ignoring all tge argumenrs I gave and dismissing my arguments in a such biased way, Sources=BS for some reason. Well, I reach out the community then for settling this issue As I said to him before, I think the tag should be removed for the following reason

His First claim: "first, contrary to what is claimed, this map is not based on any actual map" it is based on actual maps two actually that I just showed below, so this point is absurd. You will say it do not show thr battle, well I added Al Istiqsa and page number+just check wikipedia article about maghrebi war I just mimcked what is written there in a map and the article is well sourced His second claim " it has no reliable source" bruh I literally added new one and remade the map, plus again if you think gallica bnf is BS that is your problem. Plus do you know french or arabic the sources I added are in these languages so how could you judge on them?

@شادي: it looks to me like you've cited your sources, and if someone disagrees with you they should be able to say exactly where you've gone wrong. If the other user thinks your sources are "BS", then he probably should indicate exactly which of these sources he thinks are erroneous, irrelevant, etc. instead of leveling a blanket accusation.
It's up to the individual Wikipedias (and any other possible reusers) to decide whether or not to use a particular map. Unless someone presents specific evidence that absolutely invalidates a map (e.g. shows that it misrepresents the data in its claimed sources, or the uploader cannot provide any sources to back up their map and we have a strong consensus that the map is wrong, misleading, or inappropriately tendentious), we almost never delete a map from Commons. Someone who disagrees is welcome to upload their own alternative map (including a derivative version, which they may link) and site their sources. So, really, there is nothing here that needs to be resolved. The person who disagrees with you has basically said, "I think this is wrong," and not presented any substantive argument. Their remark stays; I'd trust reusers to be able to determine about what it is worth; and nothing prevents anyone from using your map.

Check the English Wikipedia for the various reliably sourced maps that we use and then compare them to one that you made up. I would also like to highlight the fact that you added sources to a map that was uploaded by someone else years ago (maybe someone here can explain to you why we don't do that). Uploading photographs of my grandfather and his art, 2 part question[edit]

Hello, my grandfather passed away in 1999 and more recently my grandmother passed away this year. There is a wikipedia page for my grandfather and I thought I would upload some photos of his art that he took himself before he passed. My father is the sole heir to everything they owned, and I'm the 2nd in line for inheritance. My father gave me permission and is encouraging me to upload these things. I just wanted to verify that there wouldn't be any issues with that.

There is also a headshot that my grandfather had professionally shot back when he was doing art shows in the 1950s that I would like to use as the picture of him for the wikipedia page. The headshot doesn't have any information attached on which studio took the picture, or if copies were ever made. I believe it is the only copy, though, as it was the only one he had in his possession. I would also like to know if that is safe to upload and use as well. Thank you for your time! I noticed that Creative Commons recently redesigned their website, so now all the license pages look different. Apparently, somewhere in this process, their page for the CC Public Domain Dedication became a deadlink. I'm guessing they assumed they didn't need it anymore since it's been deprecated and its function has been superseded by {{Cc-zero}}. However, a link to the page is still necessary for older files.

False claim of ownership[edit]

On the page "Hypertext" there is a diagram which is claimed by a certain Andreariverac. However, the diagram is a jpeg from a work that is in fact mine and I used it in various forms to explain the www in 1992. A photo of a printed CERN document from 1992 clearly shows one of those forms and the date. The original file of that document was made on a NeXT computer, which no longer exists.       Well, both: (1) the image in itself is bad quality, it should be replaced by an SVG (which I can easily make) and then (2) it should be credited to me.
      I could not find anything else by or about the other user, so I presume he/she put that image there bona-fide as illustration.
      So, I'll make an SVG (the original PostScript is lost as far as I can go back in my files, and I don't have those from the NeXT machine).
      But then what precisely are the steps to replace the existing one?

Hello,

Am not sure the copyright status for this image. It's sourced from a 1938 issue of "Aviation" magazine, which is a McGraw-Hill publication. Would like to make use of the image, as it's the best one I've found showing the variable-wingspan aspect to the plane's design. Any help to determine status would be appreciated. THanks.

@Aerohydro: the only possible basis on which that would be OK is if it's fallen into the public domain. Under current law it will certainly be public domain after January 1, 2034, but (assuming that is the original publication of the photo) the only way it would be public domain now is if the copyright on that magazine was not renewed. You could check the 1965-1966 copyright renewals (1938 + 28 years, and sometimes people renewed a little early) to see if McGraw-Hill renewed this (most likely they were either renewing all of their magazine copyrights, or none). The relevant documents are online here. If it isn't there, then it's safe to say {{PD-US-not renewed}}. - Jmabel ! talk 03:09, 25 November 2023 (UTC)Reply[reply]

Having checked the copyright entries for the mid-60s, McGraw-Hill definitely registered their contemporary publications, but as far as I can tell, didn't do any renewals.
